Delivery

In case the message that you order was sent out appears in you account status (you will also receive an information email), the package was handed over to Czech postal service. If you do not receive the ordered merchandise in 20 working days ask at your local post office if the package was not stored there. Only after you do that, turn to us with your questions.

1. You can claim the warranty by:

  • E-mail
    Send an e-mail to the address distribuce@blackpointmusic.cz

  • By mail
    Send the defective merchandise to the following address:
    	Black Point music
    	Vítkova 13
    	186 00 Praha 8

2. Every warranty claim must include following:

  • order number
  • description of found defects and their manifestations

3. The Seller will decide the validity of the claim within 3 working days after receipt of the defective merchandise and will inform the Purchaser by email if not agreed otherwise.

4. The complaint, including remedy of the defect, will be settled within 30 days from filing the warranty claim if the Seller and Purchaser do not agree upon a longer term.


Dealing with the complaints is governed by the provisions in the following law norms:
The law 136/2000, which changes the law no. 40/1964 Coll., civil code, as written in the later rules Civil code SECTION FOUR – Special provisions about selling the merchandise in store

Selected provisions:

  • The Seller or person by him authorized will decide the validity of the claim immediately, in complex cases within three working days. The Warranty Claim, including the remedy of a defect, must be settled without any undue delay, within 30 days from the day of the Warranty Claim filing, if the Seller and Purchaser do not agree upon a longer term. After expiration thereof the Purchaser is admitted the same rights as if a non-removable defect.
  • The ownership of the purchased merchandise is transferred to the Purchaser upon accepting the merchandise. If the merchandise is delivered by mail, the ownership of the merchandise is transferred to the Purchaser upon receipt of the ordered merchandise at location defined by him/her. If the Purchaser damages or breaks the merchandise before the transfer of the ownership, the Purchaser is accountable for the damages as defined in the general rules about the damage accountability.
  • The warranty time period is 24 months and starts by the day of receipt of the merchandise by Purchaser. The warranty does not cover wear of the merchandise caused by normal use. For the merchandise sold at discounted prices, those defects are not covered, for which the discounted price was set.
  • If it is possible to remedy the defect, the Purchaser is entitled to the free, timely and proper repair. The seller is obliged to remedy the defect without any undue delay. If the merchandise was not yet used, the Purchaser may require exchange merchandise instead of repair, or if the defect is in one of the parts the Purchaser may require exchange of the part. The Seller may always exchange the defective merchandise for the one without any defect.
  • If it is a defect, which cannot be remedied and it prevents proper use of the merchandise as if it was without any defect, the Purchaser is entitled to have the merchandise exchanged or to withdraw from the contract. The Purchaser is entitled to the same rights in case the defect can be remedied but because of repeated occurrence of the same defect or because of several defects the Purchaser is not able to use the purchased merchandise in proper way.

 

Money return guarantee

According to the law no. 367/2000 the Purchaser is entitled to withdraw from the contract within 14 days from accepting the merchandise without giving any reason with the exception of audio recordings and multimedia CD-ROM where the packaging was broken. The Purchaser is then entitled to return of the amount paid for this merchandise (the Seller does not have to return the amount for packaging, shipping and COD charge) when the following conditions are met:

  • returned merchandise must not be damaged or otherwise devalued, in case of multimedia and audio recordings (CD, MC, CD-ROM) the plastic must not be broken
  • the Purchaser will deliver the returned merchandise personally or by mail on his/her own expense back to the address of the Seller as a regular package. The merchandise returned as COD will not be paid attention to. The merchandise must be in perfect condition, undamaged, unbroken and qualified for the distribution
